Legal Requirements: the NOIM form

The first thing we need to do is complete The NOIM form – the Notice of Intended Marriage. This form must be lodged with me, one clear month prior to the wedding. Once lodged, the form is valid for a maximum period of 18 months.

I need to sight an original birth certificate or an extract for anyone born in Australia. For those born overseas, I need to see a passport.
If a party is divorced – I need to sight “certificate of divorce”
If a party is widowed – I need to sight a “death notice”

A week before

About one week before the wedding, you need to sign the Declaration form (Form 14), declaring that “there is no impediment to your marriage” and that you are free to marry. This is where we also do the rehearsal.

On the wedding day

On the day of the wedding, I will provide you with your “keepsake” Certificate of Marriage (which is numbered on the back) to be signed by bride and groom and your two official witnesses who need to be over 18 years old.

After the wedding – lodgement of paperwork

I will forward all legal documentation (within 14 days of the wedding) to the Victorian Registry of Births, Deaths and Marriages, to ensure registration of your marriage.You can then apply for a registered copy of your Marriage Certificate (I will supply you with relevant information). This registered copy enables you to change bank details, credit cards, passport, driver’s licence, health insurance etc…

Do I need to apply for a change of name when I marry?

Change of name to your partner’s surname is done as a matter of custom, not law. This is your personal choice. I will supply you with a “change of name” kit.

Overseas Couples/Spouse Visa

If you are applying for a Prospective Marriage Fiance Visa I can provide you with the necessary documentation for the Immigration Department. I will write a letter for you and we will also attach a copy of the Notice of Intended Marriage form. I do this for FREE.
